Terms and Conditions

Welcome to Game Tribe. These Terms and Conditions ("Terms") apply to your use of gametribedesign.com (the "Site") and to any purchase you make from us. The Site is operated by Game Tribe Pty Ltd (ABN [YOUR ABN]), Victoria, Australia ("Game Tribe", "we", "our" or "us"). By using the Site or placing an order, you agree to these Terms. Please read them carefully.

1. Use of the Site

You agree to use the Site only for lawful purposes. You must not use it in any way that infringes the rights of others or restricts their use and enjoyment of the Site. You must not attempt to gain unauthorised access to the Site, interfere with how it works, or introduce malicious code.

2. Orders and Pricing

2.1 Where you buy from us. Purchases may be made through our online store, which is powered by Shopify, or through our crowdfunding campaigns on Gamefound. Purchases made through these platforms are also subject to that platform's own terms and policies.

2.2 Prices. All prices are in Australian dollars (AUD) and include GST. Shipping is shown separately at checkout unless stated otherwise.

2.3 International orders. If you order from outside Australia, you are responsible for any import duties, taxes or customs fees charged in your country.

2.4 Availability. Products are subject to availability. We may change or discontinue products that have not yet been ordered.

2.5 Cancelling orders. We may cancel an order only if:

  • the product is out of stock;

  • there is a clear error in the price or product description; or

  • we reasonably suspect fraud.

If we cancel your order, we will tell you and refund everything you paid for it in full.

2.6 Your details. You are responsible for making sure your order details and shipping address are correct.

3. Shipping and Delivery

Delivery times are estimates. We are not responsible for delays caused by carriers, customs or events beyond our reasonable control. If you give us an incorrect address, your order may be delayed or lost. In that case, any cost of re-sending the order is your responsibility.

4. Consumer Guarantees, Returns and Refunds

4.1 Your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

4.2 Faulty, damaged or incorrect items. If your item is faulty, damaged, not as described or otherwise not of acceptable quality, or if we sent the wrong item, contact us at info@gametribedesign.com. Please include your order number, a description of the problem and photos where possible. We encourage you to contact us as soon as you notice the issue. Your rights are not limited to a fixed time period.

4.3 Change of mind. We do not offer refunds or exchanges if you simply change your mind. Nothing in these Terms limits your rights under the Australian Consumer Law.

5. Crowdfunding Pledges

Pledges made through our Gamefound campaigns are governed by Gamefound's terms and by the refund and cancellation policy published on the campaign page. Delivery estimates for campaign rewards are given in good faith. Manufacturing and shipping can sometimes cause delays, and we will keep backers informed through campaign updates.

6. Digital Content

Digital content we provide, such as digital stories, rulebooks, print files and our Tabletop Simulator module, is licensed to you for personal, non-commercial use only. You may not resell, redistribute or publicly share it without our written permission.

7. Events and Tournaments

Events we run, such as tournaments, have their own entry terms. These are published on the relevant event page and cover ticket prices, refunds, prizes and conduct. By registering for an event, you agree to those terms.

8. Comments and Community Content

8.1 Rules for comments. You may be able to post comments on the Site, for example on our stories. You must not post content that is unlawful, abusive, defamatory, discriminatory, spam or that infringes someone else's rights. We may remove any content at our discretion.

8.2 Permission to display. By posting, you allow us to display your comment on the Site and our associated channels.

8.3 Feedback and ideas. Our stories and games are developed by Game Tribe. We may be inspired by reader and player feedback, and any ideas or suggestions you share may be used freely. Sharing them does not give you any ownership of, credit for, or payment for our works.

9. Emails and Newsletter

If you subscribe to our mailing list, we will send you news, updates and offers about Game Tribe and our games. We will only email you with your consent. Every email identifies us as the sender and includes an unsubscribe link, and you can opt out at any time. We will still send you messages related to any orders you place.

10. Intellectual Property

All content on the Site belongs to Game Tribe or its licensors. This includes the Nataterra name, game designs, rules, stories, characters, artwork, text, logos and graphics. You may not copy, reproduce, distribute or commercially use any of it without our written permission. You are welcome to share links to our content and to post photos of your own games on social media.

11. Privacy

We collect and handle personal information in line with our Privacy Policy, linked at the bottom of every page. This includes your name, email address, postal address and purchase details. It explains:

  • what we collect and why;

  • how we use cookies and website analytics;

  • which service providers we share information with (for example payment, fulfilment and email providers); and

  • how you can access or correct your information.

We do not sell your personal information.

12. Third-Party Websites

The Site links to external websites and services, such as Gamefound, Shopify, Steam, Discord and social media platforms. We are not responsible for their content, terms or privacy practices.

13. Limitation of Liability

13.1 The Site. We work hard to keep the Site accurate and available. However, we do not guarantee it will be error-free or uninterrupted.

13.2 Limits. To the extent permitted by law, including the Australian Consumer Law:

  • we are not liable for indirect or consequential loss arising from your use of the Site or our products; and

  • where we are allowed to limit our liability, it is limited to supplying the goods again, replacing or repairing them, or refunding what you paid.

Nothing in these Terms excludes any right you have under the Australian Consumer Law that cannot lawfully be excluded.

14. Changes to These Terms

We may update these Terms from time to time. The current version will always be on this page, with the date it was last updated. Changes do not affect orders placed before the change.

15. General

15.1 Severability. If any part of these Terms is found invalid or unenforceable, the rest continues to apply.

15.2 Governing law. These Terms are governed by the laws of Victoria, Australia. You and we agree to the non-exclusive jurisdiction of the courts of Victoria.
